By accessing or using the Gunzo platform, including the website at gunzo.com.au and any associated web applications (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service.
These Terms constitute a legally binding agreement between you and Charles Timothy Knott (ABN 30 714 325 497), trading as Gunzo ("Gunzo", "we", "us", "our").
Gunzo is an AI-powered study tool that allows users to upload study materials, receive AI-generated practice questions derived from those materials, submit answers by text or voice and receive AI-evaluated feedback, interact with an AI Virtual Tutor for conversational learning, and track study progress over time. The Service is provided on a subscription basis as described in Section 5.
You must be at least 13 years of age to use the Service. Users aged 13–17 must have the consent of a parent or legal guardian. By creating an account, you represent that you are at least 13 years of age, have the legal capacity to enter into a binding agreement, and that all information you provide is accurate and complete.
To access the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials, all activity that occurs under your account, and notifying us immediately at [email protected] if you suspect unauthorised access. We reserve the right to suspend or terminate accounts we reasonably believe have been compromised or used in violation of these Terms.
You retain all ownership rights in the study materials and other content you upload to the Service ("Your Content"). By uploading content, you grant us a limited, non-exclusive, royalty-free licence to process, store, and use Your Content solely for the purpose of providing the Service to you.
You must not upload content that infringes third-party intellectual property rights, contains personal information about others without their consent, is defamatory, obscene, or unlawful, or contains malware or harmful code. We reserve the right to remove content that violates these Terms.
You acknowledge that Your Content will be processed by third-party AI services (OpenAI and Anthropic) to generate questions, evaluate answers, and power the Virtual Tutor. We do not use Your Content to train AI models.
All intellectual property in the Service, including the software, design, branding, AI-generated questions, feedback, and tutor responses, is owned by or licensed to Gunzo. Nothing in these Terms transfers any intellectual property rights to you. If you provide feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free licence to use that feedback for any purpose.
The Service uses artificial intelligence to generate practice questions, evaluate answers, and provide tutoring responses. While we strive for accuracy, AI-generated content may contain errors, omissions, or inaccuracies. You should not rely solely on AI-generated content for academic assessments, professional qualifications, or any purpose where accuracy is critical. We make no warranty that AI-generated content is correct, complete, or suitable for any particular purpose.
You must not use the Service for any unlawful purpose; attempt to reverse engineer or extract source code from the Service; use automated tools to scrape or extract data; share your account credentials; attempt to circumvent security measures; or use the Service in a way that damages or impairs it or interferes with other users.
We aim to provide the Service continuously but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue any part of the Service at any time. Where we make material changes, we will provide reasonable notice via email or in-app notification.
To the maximum extent permitted by law, including the Australian Consumer Law, our total liability to you for any claim arising out of or in connection with the Service is limited to the amount you paid us in the 3 months preceding the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or opportunity.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term implied by the Australian Consumer Law that cannot lawfully be excluded or limited.
Our Service comes with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Service remedied if it fails to be of acceptable quality.
We may suspend or terminate your account at any time if you breach these Terms or if we reasonably believe your account is being used fraudulently. Upon termination, your right to use the Service ceases immediately. You may request an export of your data within 30 days of termination, after which it will be deleted.
Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference.
These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales for any dispute arising out of or in connection with these Terms. Before commencing legal proceedings, you agree to contact us at [email protected] and attempt to resolve the dispute in good faith within 30 days.
We may update these Terms from time to time. We will notify you of material changes by email to your registered address with at least 14 days' notice. Your continued use of the Service after the effective date constitutes acceptance of the new Terms.
